Changes to Law on Tenants' Deposits


Landlords and Letting Agents are now required in the majority of cases to lodge their tenants' deposits with one of the Scottish Government approved Tenant Deposit Provider Schemes before 13 November 2012. 

We have elected to use Safe Deposits Scotland for all Rollos managed properties.  This is a Scottish based non-profit organisation set up by inter alia the Royal Institute of Chartered Surveyors, the National Union of Students and the Scottish Landlords Association. 

The Scottish Government will send out notification to registered Landlords and Letting Agents about their rights and responsibilities under the scheme and the onus is on them to ensure that deposits are lodged and that the tenants are duly informed.  It is anticipated that substantially more evidence will require to be made available to justify the deposit schemes releasing funds to Landlords for repairs, cleaning costs etc. following termination of a tenancy.

We are happy to advise on the most effective ways to establish a claim on the deposits if required.
